RENTAL AGREEMENT TERMS & CONDITIONS
Please read carefully prior to signing or electronically signing this Rental/User Agreement (“Agreement”). The following terms and Conditions supplement the Rental Agreement and together form the contractual agreement between all renters, authored drivers and Legends Car Rentals. The Term “Vehicle” means the rental vehicle. The term “Renter” means all renters and authorized drivers identified on the Rental Agreement, provided each person has a valid Driver License. The terms “You” or “Your” or “User” in this Agreement mean any and all authorized drivers. The term “Vehicle” means the vehicle loaned to You, all its tires, tools, keys, accessories and documents. “DUE DATE” is the date through which time You have established the reservation of the Vehicle online, or the date that You later obtain in writing in response to submitting a request for extension.
NOTICE ABOUT YOUR FINANCIAL RESPONSIBILITY AND OPTIONAL LOSS DAMAGE WAIVER
You are responsible for all collision damage to the vehicle You rented even if someone else caused it or the cause is unknown. You are responsible for the cost of repair up to the value of the vehicle, and towing, storage and impound fees. Your own insurance, or the issuer of the credit card You use to pay for this transaction to borrow the vehicle, may cover all or part of Your financial responsibility for the vehicle You are borrowing. You agree to indemnify us, defend us and hold us harmless from and against all claims, liability, costs and attorney fees we incur resulting from, or arising out of this rental. We make no warranties, express, implied or apparent, regarding the vehicle, no warranty of merchantability and no warranty that the vehicle is fit for a particular purpose.You should check with Your insurance company, or credit card issuer, to find out about Your coverage and the amount of deductible, if any for which you may be liable. Further, if You use a credit card that provides coverage for potential liability, You should check with the issuer to determine if You must first exhaust the coverage limits of Your own insurance before the credit card coverage applies. Legends Car Rentals will not hold You responsible if You buy a Loss Damage Waiver (LDW). But a collision damage waiver will not protect You if exceptions apply. See UNAUTHORIZED USES AND LDW EXCLUSIONS below.
LOSS DAMAGE WAIVER NOTICE (LDW)
By signing or electronically signing this agreement, USER accepts responsibility for all damages up to the full value of the vehicle. By signing ACCEPT, USER agrees: (1) to pay the daily rate for LDW; and 2. that USER has received oral notice that LDW is optional and may be duplicative of insurance coverage provided by USER’s own policy. For limits or exclusions on LDW, see UNAUTHORIZED USES AND LDW EXCLUSIONS WARNING:
YOUR DUTIES
You will breach this agreement if You do any of the following: 1. Take the vehicle outside California or into Mexico without written permission of Legends Car Rentals. 2. Allow anyone not authorized in writing to operate this vehicle and or use the vehicle for any illegal or improper purpose. 3. Failure to return the vehicle by the DUE DATE.If You have not returned the vehicle within five days of the DUE DATE, Legends Car Rentals will report the vehicle as embezzled / stolen, and You are subject to arrest, and the vehicle may be seized from You. 4. If You fail to keep payments for this User Agreement current or Your credit card becomes declined or invalid.
RETURN, REPOSSESSION, AND COSTS
Only the individual(s) approved on this Agreement as an Authorized Driver is / are permitted to operate/drive the Vehicle. The Vehicle is the property of the registered owner (hereafter “OWNER”) who has authorized Legends Car Rentals to rent this vehicle. User agrees to return the Vehicle, together with all tires and equipment to Legends Car Rentals: (1) in the same condition as when received, ordinary wear and tear excepted; (2) to the agreed location; (3) On the DUE DATE as defined, or an earlier date if requested by Legends Car Rentals upon 24 hours notice. Legends Car Rentals or OWNER may peacefully repossess the vehicle without demand or notice at any time if: [a] the Vehicle is used in violation of law; [b] the Vehicle is used in violation of any term or condition of this User Agreement; [3] the Vehicle is apparently abandoned; [4] the Vehicle is illegally parked and/or subject to towing; or [5] the Vehicle is not returned by the due date specified on this User Agreement. Useris liable for parking charges, parking citations, towing, storage and impound fees arising from the use under this Agreement. In the event the Vehicle is beyond 75 mile of the pick-up location, the User is responsible for the cost of transporting the Vehicle back to the pick-up location, including the costs of a driver, lodging, and meals. User is liable for losses and costs incurred in retrieving or recovering the Vehicle. User authorizes Legends Car Rentals to charge User’s credit or debit card for parking violations during the use period as well as up to $50 in administration fees per violation for processing of the same.
ACCIDENT LIABILITY
No automobile insurance is sold in conjunction with this agreement unless You procured SLI or RLI insurance. Otherwise, You are 100% responsible in the event of an accident or injury to a third person. Neither Legends Car Rentals nor Owner accept vicarious liability for Your negligence. Thus, You agree that You are entering this agreement without relying upon any promise from Legends Car Rentals of insurance for accident liability that You may have to a third person for bodily injuries or property damages You may cause or be responsible for. YOUR PROPERTY You release us, our agents and employees from all claims for loss of, or damage to, your personal property or that of any other person, that we received, handled or stored, or that was left or carried in or on the Vehicle or in any service vehicle or in our offices, whether or not the loss or damage was caused by our negligence or was otherwise our responsibility.
COLLISION DAMAGE, REPAIR COSTS, THEFT
You are responsible for returning the Vehicle in the same condition as when received, less reasonable wear and tear. You are responsible for all damage to or loss of the Vehicle, regardless of cause or fault. You are responsible for the cost of repair, up to the fair market value of the Vehicle, loss of use (measured by the daily use rate of the Vehicle) to the extent authorized by law, diminished value, towing, storage, impound fees, administrative fees up to $150 or as allowed by law; and all other costs and fees authorized by law. If the Vehicle is not returned to Legends Car Rentals in the same condition as when received by You for any reason, including an alleged theft, You are fully responsible for the fair market value of the Vehicle and other damages to the full extent provided by law. The User’s insurance or credit/debit card company may cover all or part of Your financial responsibility for damages or loss to the Vehicle. You should check to find out about the scope of Your insurance coverage(s), and what deductible may apply. The OWNER or Legends Car Rentals will not hold You responsible for the damage and/or loss of use if the User purchases Loss Damage Waiver (LDW), except if a provision is violated in the Section above — Unauthorized Uses & LDW Exclusions. In the event such a provision is violated, the Loss Damage Waiver (LDW) shall be deemed voided. Under such circumstances, each of You, singularly and jointly, is fully responsible for any damage, repair costs, loss of use, and all other related costs and charges allowed by law. Loss Damage Waiver (LDW) does not cover loss or damage due to theft or vandalism. If User purchases LDW, You remain liable up to the full value of the Vehicle in event of theft or vandalism. If the Vehicle is not returned to Legends Car Rentals for any reason, including an alleged theft,You are fully responsible for the fair market value of the Vehicle to the full extent provided by law.
PROTECTING THE VEHICLE
You agree to take all reasonable steps to protect the Vehicle from damage and theft, including but not limited to: (1) Obeying all speed and traffic laws; (2) Not drinking any beverage or eating any food while in the Vehicle; (3) Not smoking while operating, or occupying the Vehicle; (4) Not operating the Vehicle while under any influence of drugs or alcohol; (5) Closing all windows, closing sunroof or convertible top, locking all doors, and arming the Vehicle’s security system in the event the Vehicle is left for any length of time, no matter how brief; (6) Not to leave the Vehicle ignition key in the ignition, interior door, or trunk when the Vehicle is not in use; (7) Not to give the ignition key to any person, including any parking valet attendant or other person who is not an authorized driver under this User Agreement; (8) Not to leave personal effects (e.g., cameras, camcorders, gifts) or valuables in the Vehicle.
CUSTOMER USE CHARGES & DEPOSIT
User will pay Legends Car Rentals on demand all incurred charges, including but not limited to: weekly, daily use charges at the rate specified on the User Agreement; mileage charges; additional equipment charges; Loss Damage Waiver (if accepted); refueling charges; airport surcharges; pickup or delivery charges; cleaning fees if You smoke in the vehicle; and other fees and miscellaneous charges when applicable; state, local sales, excise and use taxes when applicable. All charges that are unpaid at time of return of the Vehicle accrue interest at 10% per annum, compounded annually. We may use your deposit to pay any amounts owed to us under this Agreement.In the event any amount due under this Use Agreement is billed to another person or organization, User shall remain jointly and severally liable for all such charges.
INSURANCE ISSUES
Legends Car Rentals is not agreeing to insure You against any claim for bodily injury or property damage arising from Your use and/or operation of the Vehicle. You and Your insurer are primarily liable for all bodily injury or property damage claims under California law in the event You are involved in an accident with a third party . CDW when purchased by You is only a waiver of a cl aim for property damage (not theft) by Legends Car Rentals if damage/loss occurs during the use period authorized under this Agreement. CDW is thus not insurance. However, if You purchase Supplemental Liability Insurance (SLI) or Renter Liability Insurance (RLI), You may be covered for liability to third-parties under the terms of the policy offered by the SLI or RLI carrier.
UNAUTHORIZED USES & LDW EXCLUSIONS
Each User, including each authorized driver, shall be fully responsible for all loss or damage to the Vehicle, regardless of fault or cause. The acts and/or uses listed below are prohibited and violate the scope of permissive use of the Vehicle. If Loss Damage Waiver(LDW) protection has been purchased, any of the following acts, uses, or operations of the Vehicle will void the LDW waiver: (1) Operation of the Vehicle by anyone who is not an authorized driver accepted under this User Agreement; (2) Use of the Vehicle for commercial hire and or providing false or fraudulent information to Legends Car Rentals; (3) Use of the Vehicle in a willful, wanton, or reckless manner; (4) Use of the Vehicle in connection with conduct that can be charged as a felony; (5) Use of the Vehicle in any speed test, contest or driver training activity; (6) Use of the Vehicle to push or tow any vehicle or trailer; (7) Operation of the Vehicle off-road or on any unpaved road; (8) Operation of the vehicle by someone under the influence of drugs/alcohol in violation of Ca Vehicle Code Section 23152; (9) Operation of the Vehicle outside the State of California unless consented to in writing by Legends Car Rentals; (10) Operation of the Vehicle outside the USA unless consented to in writing by Legends Car Rentals; (11) Driving the Vehicle without a valid driver’s license or with a license which has been suspended or revoked.
RENTAL AGREEMENT TERMS & CONDITIONS CONTINUED VEHICLE LIMITATIONS
Please remind each driver and valet of these important instructions: 1. The vehicle rented is not to be used as a tow or transport vehicle. (for example) tow units, trailers, & hitch connected devices. 2. If the vehicle is equipped with 4×4 suspension please do not off-road our vehicle. 3. SUV’S are top heavy vehicles take into consideration speed when turning. 4. Be aware of the size of the vehicle when parking. 5. NO SMOKING IN THE VEHICLES. There is an ionizing fee of $400.00 for Luxury, Classic and Sports vehicles and $600.00 for Exotics. 6. Vehicle service is limited to 75 miles from the Legends car rentals office. Outside of 75 miles client assumes all responsibility for mechanical failures, breakdowns, tire damage, towing and other incidentals. 7. No commercial or business use. If you intend to use the car for business please contact our representative to discuss your options.
CLASSIC CAR INSTRUCTIONS
1. Every Classic Car needs to warm up, especially in the morning. The best way to start up the car is pumping the gas pedal 3 to 5 times, before you turn the ignition on to start the vehicle. 2. Classic cars tend to burn water and oil in normal driving conditions, we ask that you check the levels every 100 miles, monitor the temperature gauge at all times, and keep the gasoline level above 1⁄4 to avoid issues. 3. Considering the age of the vehicles, around 40 years each, be extremely gentle with the cars; do not abuse the vehicle or make high speed maneuvers. 4. Battery life is very important, each time you stop the car make sure that the key is in OFF position and there are no lights on in the dash board, check the radio to assure that is off as well as the vehicle lights since they are manual, these cars can lose their battery quickly if power is left on. 5. Please, be sure to mention these important points to the Valet Parking Attendants, most of the time they are the ones scratching the vehicles and causing troubles. 6. Vehicle service is limited to 75 miles from the Legends office. Outside of 75 miles client assumes all responsibility for mechanical failures, breakdowns, tire damage, towing and other incidentals. 7. No commercial or business use. If you intend to use the car for business or commercial purposes, you must get prior written authorization from Legends Car Rentals. Please contact our representative to discuss your options.
MECHANICAL BREAKDOWN, ROADSIDE SERVICE
In the event of a mechanical breakdown or malfunction, You will cease operation of the Vehicle at the first sign of mechanical trouble. In such an event, You will contact Legends Car Rentals immediately. User will not authorize or attempt any repair(s) to the Vehicle without Legends Car Rentals prior written approval. You are fully responsible for any unauthorized repair(s) and any damage caused thereby. Any service to, or replacement of, a part or accessory on the Vehicle must have Legends Car Rentals’s prior written approval. If You smell oil, gasoline, or any kind of burning, You shall in a safe manner immediately stop the Vehicle and immediately call Legends Car Rentals for roadside service. Legends Car Rentals will come out and inspect the Vehicle and made arrangements for a replacement vehicle, if appropriate. In case of fire, please call the fire department first. You agree that Legends Car Rentals shall not be liable for in whole or in part for any indirect, special, or consequential damages, including without limitation, loss of time, income, lodging, personal expenses, loss of benefits, suffered or incurred by You or any third person relating to or arising out of the furnishing, performance, or use of the Vehicle, including mechanical breakdown or failure to honor a reservation. If a client experiences a mechanical breakdown or a malfunction of any kind, client is intitled to a refund or a partial refund ONLY if Legends Car Rentals can not provide a comparable replacement vehicle for the duration of the rental period.
CHILD CAR SEATS CALIFORNIA LAW REQUIRES ALL CHILDREN UNDER 8 YEARS OF AGE TO BE TRANSPORTED IN THE REAR SEAT OF THE VEHICLE IN A CHILD RESTRAINT SYSTEM. THIS AGENCY IS REQUIRED TO PROVIDE FOR RENTAL OF A CHILD RESTRAINT SYSTEM IF YOU DO NOT HAVE A CHILD RESTRAINT SYSTEM YOURSELF. (Cal. Veh. Code sec. 27365.) If YOU have children under 8 years of age, and intend to drive away immediately upon picking up the Rental Vehicle, You must have notified Legends Car Rentals in advance, which will then store a child car seat in the trunk for YOUR use. Otherwise, You may not lawfully drive with the children without a car seat. Legends Car Rentals is not responsible for property left in the Vehicle on its return or at anytime.
